Why this matters:
Uncollected devices take up secure workspace, tie up parts, and create data‑security and environmental risks. These Terms & Conditions explain what happens if a customer leaves a device with us and does not collect it. By leaving a device with PC Revamp York for diagnosis, repair, data services or any related work, you agree to these Terms.
1. Key Definitions
Device – Any phone, tablet, laptop, wearable, accessory, or related equipment left with us for assessment, repair, data recovery, recycling, warranty work, or quotation.
Customer / You – The individual or business entity that owns (or lawfully controls) the device and instructs us to carry out work.
Repair Order – Our job record created when you book online, drop off in store, or authorise work by phone/email.
Completion Date – The date we notify you that your device is ready for collection (whether fully repaired, beyond economic repair, declined, or not proceeded with).
Uncollected Device – A device that remains in our possession 90 calendar days after the Completion Date, and for which we have made reasonable attempts to contact you.
Charges – All sums due to us, including (as applicable) diagnostic fees, repair labour, parts, software licensing, data recovery, disposal costs, administration fees.
2. Legal Basis & Our Status as Bailee
When you leave a device with us, we become a bailee of your goods – we hold and care for them, but ownership remains with you unless transferred by agreement or lawful sale. UK law (including the Torts (Interference with Goods) Act 1977) allows a bailee, after giving proper notice, to sell or otherwise dispose of uncollected goods in order to recover unpaid charges and reasonable costs. These Terms set out how PC Revamp York applies that legal framework in a transparent, consistent way.
3. Contact Details – Your Responsibility
You must provide at least one working contact method (mobile number, email address) and ideally a postal address. If your contact details change while your device is with us, you must update us in writing. We are not responsible for delays or disposal actions caused by your failure to maintain valid contact details.
5. When a Device Becomes “Uncollected”
A device becomes an Uncollected Device if 90 calendar days pass after the Completion Date and either:
- The device has not been collected, or
- Agreed charges remain unpaid, or
- You have not responded to our Final Statutory Notice.
Once a device is classed as Uncollected, we may exercise the rights in Sections 8–11.
6. Our Lien – Right to Retain Goods Until Paid
We have a general repairer’s lien over your device: we are entitled to retain possession until all agreed and reasonable charges relating to the device are paid in full. We will not release the device until cleared payment is received, unless otherwise agreed in writing.
7. Storage Charges
We do not charge any storage fees within the 90-day collection window. No VAT is applicable as no storage fee is charged.
8. Final Statutory Notice (Issued ~ 7 days notice)
Before we sell, recycle, or dispose of an Uncollected Device, we will issue a Final Statutory Notice of Intention to Sell / Dispose that:
- Identifies PC Revamp York and the customer.
- Describes the device(s) being held.
- States the amount owed.
- Gives a final deadline: 7 days from the date of notice.
- States that, if unpaid/uncollected by the deadline, we may sell the device or recycle / responsibly dispose of it.
Where a postal address has been supplied, we send this notice by recorded delivery and also by email/SMS.
9. After the Final Deadline – What We May Do
If payment and collection do not occur by the deadline, we may:
1. Sell the Device – via retail, parts harvesting, or auction.
2. Recycle / Break for Parts – if device has negligible resale value.
3. Environmentally Responsible Disposal – for zero-value items.
10. Accounting for Proceeds & Surplus Funds
Proceeds are applied in the following order:
1. Sale costs.
2. Repair & Service Charges.
3. Other Agreed Charges.
Surplus: Any remaining balance will be held for the customer for 6 years.
11. Data Security & Privacy
We attempt to wipe data before sale or disposal. If we cannot wipe the device (e.g. due to damage), it may be sold for parts or recycled. Data cannot be recovered once wiped or recycled.
12. Risk of Loss & Insurance
We take reasonable care of your device. Our liability is limited to the replacement or market value at the time of drop-off, unless consumer law gives you additional rights.
13. Collection Requirements
The persons who dropped off must be the collector of your device unless we have in writing to say otherwise (should a family member or friend collect on your behalf).
14. Devices Without Contact Info
Devices left without identifying info and unclaimed after 90 days may be responsibly disposed of.
15. Refused Repairs / BER
Devices deemed BER or declined still fall under the 90-day rule from date of notification.
16. Trade / Institutional Customers
Contracted collection windows take precedence. Otherwise, these terms apply.
17. How You Accept These Terms
You accept these Terms when you:
- Receive our reminder SMS message (usually sent out after 7 days of a non collected device) which will show as ‘Delivered’. This SMS will link you to our terms and conditions.
- Complete an online booking;
- Leave a device after being shown these terms;
- Authorise work and deliver the device.
18. Disputes & Complaints
Raise disputes within 14 days of awareness. We aim to respond within 14 business days. You may use ADR or Small Claims Court if unresolved.
19. Force Majeure & Extensions
Contact us before the 90-day deadline in case of hardship. We may grant a 30-day extension and pause storage fees.
